DOJ ibinasura ang kaso kay Marcelino

MANILA, Philippines – Dahil sa kawalang ng ebidensya, ibinasura ng Department of Justice (DOJ)  ngayong Martes ang kason inihain laban kay  Marine Lt. Col. Ferdinand Marcelino.

Sinabi ni Senior Deputy State Prosecutor Theodore Villanueva na wala silang nakitang probable cause para ituloy ang kasong paglabag sa gun ban at illegal drug charges na inihain ng Philippine Drug Enforcement Agency against him.

Iniutos din niya ang pagpapalaya kay Marcelino.

“Premises considered the undersigned recommends the dismissal of the case for insufficiency of evidence without prejudice to whatever evidence the PDEA and PNP-AIDG (Philippine National Police-Anti-Illegal Drugs Group) would again submit to corroborate their complaint against respondents LTC Ferdinand Marcelino, PN and Yan Yi Shou,” nakasaad sa resolusyon ni Villanueva.

“It is further recommended that they be released from detention unless other lawful cause to the contrary,” dagdag niya.

Inireklamo si Marcelino ng paglabag sa Sections 11 at 26 ng Republic Act 9165 o ang Comprehensive Dangerous Drugs Act of 2002.

Nasakote si Marcelino at Chinese Yan Yi Shou nitong Enero sa isang hinihinalang drug laboratory sa Maynila.

Nakuhaan ng 64 kilo ng shabu sina Marcelino at Yan na nagkakahalaga ng P256 milyon.

Naunang sinabi ni Marcelino na lehitimo ang kaniyang operasyon na isang undercover para siyasatin ang umano’y shabu laboratory.
