Man faces complaint for acts of lasciviousness

CEBU, Philippines - A man who allegedly performed lascivious acts on a 15-year-old female student by kissing her and touching her private body parts will be facing a criminal charge before a trial court.

The Office of the Cebu City Prosecutor found reasonable ground to hold Marjun Trocio Mata for trial for violation of Section 5 (b) of Republic Act 7610 or the Special Protection of Children Against Abuse, Exploitation and Discrimination Act.

In his resolution, Prosecutor Rodulph Joseph Val Carrillo said the act of Mata has "debased, degraded or demeaned the intrinsic worth and dignity of the minor" as a human being.

Section 5(b) of the law imposes the penalty of up to 40 years upon those who commit the act of sexual intercourse or lascivious conduct with a child "exploited in prostitution or subjected to other sexual abuse."

The case stemmed from the complaint of the minor who reported to the police following the incident last September 20.

In her complaint-affidavit, the minor said that she was helping her siblings close the store of their uncle, who serves as their guardian, when Mata approached her.

Mata reportedly hugged her tight, kissed her and pressed her buttocks and breasts.

Mata was allegedly drunk at that time. The minor said she did not know Mata.

A group of people who were in the area got mad after seeing the incident and attacked Mata, she added.

 "Tungod sa ako kahadlok nidagan ko ug nisyaget para mangayo og tabang sa ako auntie," she said.

She also reported the incident to the police who then arrested the suspect.

The prosecution office recommended P200,000 bail for the temporary liberty of Mata. (FREEMAN)
