Exempted ba ang Capitol sa Ord. No. 2326?

Bisan sa una pang administrasyon, kada anha nako sa Capitol, pabayron gyud ko sa parking. Inigpangutana nako kun ila bang gi-implement ang City Ordinance No. 2326 nga naghatag og free parking sa first three hours nga pag-park sa mga senior citizens, ang parking attendant nga tigdawat sa bayad, igo lang mosiga ang mata.

Bayad lang pud ko, walay kusmodkusmod … pakapinan pa’g smile. Nagtuo ko nga lagmit exempted ang Capitol sa maong ordinansa.

Ang ubang mga establishment, sama sa mga hospital, mga mall, ila na ning gi-implement. Gani, sa E-Mall pananglitan, pangutan-on ka pa kun duna ka bay ID. Mao sad sa Cybergate, waa ko’y bayadbayad sa parking. Igo lang ipakita ang OSCA ID.

Pero sa Capitol, bayad gyud ka hangtud karon. Sige ra ba ko’g anha sa Capitol kay mobayad sa akong utang sa Coop.

Anyway, ania ang Ordinance No. 2326, in case waa mahibawo ang Capitol ini:  An ordinance granting qualified exemption to all senior citizens and persons with disability from the payment of parking fees in malls, hospitals, or any other establishments that have parking facilities prescribing penalties therefor, and for other purposes.”

 Klaro man unta. Kun waa sila mahibawo ini, waa ni magpasabot nga exempted sila. Perhaps, tungod kay waa sila ma-mention, exempted na sila. Ignorance of the law excuses no one man kaha?

Sa Section 3 sa maong ordinansa … Definition of Terms, letter (d), nagkanayon: “Pay Parking Facilities  refer to an area or building reserved for parking vehicles, public or private, and charges fees for its usage.” Public man tingali nang parking area sa Capitol.

Section 7, Penalties: First offense – Cashier or booth attendants: P500 fine or imprisonment of 1 day to 30 days or both; Operator or Manager: P2000 fine or imprisonment of 1 day to 30 days or both;

Second offense – Cashier or booth attendant: P1000 fine or imprisonment of 1 day to 30

 days  or both; Operator/Manager: P3000 fine or imprisonment of 1 day to 30 days or both;

Third offense – P2000 fine sa cashier or booth attendant, or imprisonment of 1 day to 30 days or both; P5000 na sa operator or manager, or imprisonment of 1 day to 30 days or both.

So, duna gyu’y multa. Lagmit wa’a gyu’y labut ang Capitol tungod kay dili man commercial establishment as specified sa Sec. 3 – c, apan public parking man. Agad lang ni sa interpretation sa mga abogado. Ila na ni. In the meantime, bayad lang ko sa parking.
