Rules on 3-wheeled vehicles in effect in three Talisay villages

CEBU, Philippines - Barangays San Roque, Cansojong, and San Isidro in Talisay City will strictly adhere to the guidelines and standards for the operation of tricycles and pedicabs in local government units.

Talisay City legal officer Alfredo Sipalay, in his letter to barangays, cites City Ordinance 2004-04, which prohibits tricycles, bicycles, and animal-drawn carts from travelling the Cebu South Coastal Road (CSCR). 

“Kun simbako dunay madisgrasya diha sa coastal road nga maglambigit sa mga trisikad, ang mayor dayon maoy basulon kay wa makabadlong. So, nalipay ta nga nipasalig ang mga kapitan nga motabang sila sa pagdakop aning mga trisikad nga mosugat ra ba usahay sa mga sakyanan,” Sipalay said. 

Mayor Johnny De los Reyes also said the volume of vehicular traffic at the CSCR has increased in recent years due to the presence of prohibited vehicles, particularly trisikads. 

De los Reyes said tricycles and trisikads disrupt the steady flow of the CSCR by using the wrong lanes while travelling.

The Department of Interior and Local Government has issued Memo Circular 2007-01, banning tricycles and pedicabs to operate “on national highways utilized by four-wheel vehicles greater than four tons and where normal speed exceeds 40 kph.”

The same directive prescribes the minimum standards to be adopted by city and municipal governments in the formulation of a regulatory code for tricycle and pedicab franchise operation, including physical requirements/ equipage, fares, load/capacity limit, and operating conditions.

Sections 447 and 458 of the Local Government Code has conferred unto municipal and city governments, through their sanggunians, the power to regulate the operation of tricycles and the grant of franchise for their operation within their territorial jurisdiction, subject to the guidelines prescribed by DOTC.  (FREEMAN)
