No bail for woman in illegal drug possession case

CEBU, Philippines - The Cebu City Prosecutor’s Office has recommended no bail against a woman allegedly caught possessing illegal drugs.

Prosecutor II Aurora Peñaflor held Marilyn Mayang, for trial for violation of Section 11 of Article II of Republic Act 9165 otherwise known as the Comprehensive dangerous Drugs Act.

“Clearly, the undersigned finds probable cause to indict respondent determining that all the elements of illegal possession of dangerous drugs as punished under Section 11, Article 2 RA No. 9165, was established in the uncontroverted attendant facts of this case,” read the resolution.

In their joint-affidavit, Police Senior Inspector Joey Bicoy and other police officers assigned at the Regional Anti-Illegal Drugs Special Operations Task Group (RAIDSOTG)-7 stated that on March 23, they received information that Mayang, who has a standing warrant of arrest for illegal possession of shabu, was sighted in her residence in sitio Mahayahay, Barangay Calamba, Cebu City.

The police officers immediately acted on the report and proceeded to Mayang’s residence.

The cops introduced themselves as police officers, but she threw a dark-green synthetic leather pouch at them then ran to the second floor and jumped through the window.

Mayang was able to elude arrest while the cops later found out that the pouch thrown at them contained 13 medium heat-sealed transparent plastic sachets of suspected shabu weighing 59.8 grams and cash of P3,100 believed to be proceeds from the illegal drug trade.

Peñaflor summoned Mayang to file her counter-affidavit to negate the allegations filed against her but she failed to present any.

Hence, the prosecutor resolved the complaint based on the evidence of the RAIDSOTG. — Mylen P. Manto/ATO (FREEMAN)
