Murder rap sought vs. cop who killed cop

The family of PO1 Calvin Dinampo, the policeman who was killed in an alleged shootout with another policeman last Christmas Eve, wants the homicide case against the accused upgraded to murder.

The counsel for the complainants, Arnold Valle, asked the Regional Trial Court to order a reinvestigation of the case against PO1 Mark Anthony Manlosa citing new witnesses who can testify that Dinampo’s killing was planned.

In a two-page motion for reinvestigation filed before the RTC Branch 5, Valle asked that court remand the case to the Cebu City Prosecutors’ Office for reinvestigation.

Valle said they found witnesses who were not interviewed by homicide investigators who can prove Dinampo’s killing was a “well-planned execution”.

According to the affidavits of the new witnesses, a few hours before Dinampo was killed, Manlosa and another policeman PO1 Roel Ragasajo as well as several other unidentified men were already looking for the victim.

In fact, one of the witnesses said in his affidavit that he heard Ragasajo saying that they will kill somebody before Christmas comes.Another witness claimed that he and his younger sister were talking with Dinampo when the accused arrived on board a motorcycle with a man riding pillion, approached the victim and asked if he was a policeman.

The man, whom the witness later identified as Manlosa, hit Dinampo in the shoulder but the latter did not mind him.Dinampo was repeatedly hit thrice until he tried to parry the arm of the person hitting him.

However, a gunshot rang out and Dinampo fell to the ground. The witness further claimed he was surprised to know that a 9mm pistol was recovered from Dinampo as he was allegedly not armed during the incident.

Valle also questioned the number of gunshot wounds that Dinampo sustained saying the accused really made sure that Dinampo was dead.

Based on the investigation conducted by the Homicide Section the shooting to death of Dinampo was a legitimate encounter, Manlosa was allegedly responding to an armed person alarm when Dinampo reportedly took a firecracker vendor hostage when accosted by the accused.

The shootout allegedly took place at the corner of Gold and Silver streets in barangay Tisa around 7:30 p.m. last December 24. — Fred P. Languido/BRP
