Lesbian charged with sexual abuse

CEBU, Philippines — A lesbian is facing charges before the court for allegedly sexually molesting her 16-year-old “girlfriend” inside a house on Colon Street in Cebu City.

Prosecutor II Misty Leah Escolar-Hupp held the accused, a resident of Talisay City, for trial after finding probable cause for violating Section 5 (b) of Republic Act 7610 or The Child Abuse.

The FREEMAN is withholding the names of the parties involved due to the sensitive nature of the case.

The victim, a resident of Cebu City, said she was “dating” the accused, whom she met on July 2, 2017 in the suspect’s school in Talisay.

At around 2 p.m. on September 21 last year, the victim said she went to Colon Street to meet up with the suspect upon the latter’s request.

The victim was told by the accused that she needs to buy some textile for her uniform.

Instead of going to a store, the accused, however, led the victim to an alley and then into a two-story wooden house.

The victim said the accused made her believe the house was owned by her family and now being occupied by her uncle and aunt.

The victim said she was brought inside the house and the accused started sexually abusing her.

After the incident, the victim confessed to her mother about the alleged abuse.

The mother brought her daughter to the Waterfront Police Station and reported the incident.

The victim reportedly had bites marks and could barely walk after the alleged sexual abuse.

On November 10, 2017, Hupp issued a subpoena directing the accused to file her counter-affidavit to answer the allegations filed against her.

The suspect said what they “did” was with the consent of the victim, saying she could never hurt someone she loves.

The suspect claimed that the victim was her girlfriend.

However, Hupp ruled in favor of the victim, citing that the minor was subjected to other sexual abuse.

“It was upon the machination of ‘accused’, an adult, that complainant found herself in a helpless situation. Complainant fell prey to accused’s sweet talks that she blindly followed the latter to her lair. When the dumbfounded child found herself struck to the bait, she was powerless to fight its venomous effects. Her strength failed her and was no match to that of accused,” read Hupp’s resolution. 

Hupp added that the accused was able to “succeed in violating the complainant’s body.”

The prosecutor recommended a P200,000 bail for the suspect’s temporary liberty while the case is being heard before the court. — KBQ (FREEMAN)
