'Gag order' inilabas ng korte sa Kris-James case

MANILA, Philippines –  Naglabas ng ‘media gag’ order ang Makati Regional Trial Court Branch 144 ngayong Biyernes kasunod ang mga isyu sa pagitan ng datingh mag-asawang sina Kris Aquino at James Yap.

Ito ang nabatid nang mariing tumanggi si dating solicitor general Frank Chavez, abogado ni Aquino, na magbigay ng anumang detalye hinggil sa hold departure order (HDO) na inihayin ni Yap sa korte upang pigilang lumabas ng bansa si Kris at ang kanilang anak.

“You’ll get nothing. Our lips are sealed.  We are going to respect to the court. We are not giving any statements on what had happened because the HDO (hold departure order) application has already been submitted for resolution,” pahayag ni Chavez na dating Solicitor General sa mga mamahayag na nag-aabang sa labas ng courtroom ni Judge Liza Marie Picardal-Tecson.

Dininig ng korte ang petisyon ni Yap, na inihayin nitong Marso 20, upang hindi makalabas ng bansa si Aquino at ang limang-taong-gulang na si James Yap Jr. o mas kilala sa palayaw na Bimby. Hindi naman hinayaan ang mga mamamahayag na pumasok sa loob ng courtroom.

Ayon naman sa abogado ni Yap na si Lorna Kapunan, kapwa ang dalawang panig ang humiling ng gag order sa hukuman.

“We have a gag order from the court. Both parties asked for it. Ulitin na lang natin ang prayer ng family at ipagdasal na lang natin silang lahat,” sabi ni Kapunan.

Sinabi ni Chavez na patuloy ang bisa ng gag order hanggang maglabas ng merits ng kaso ang korte.

“Hanggang madisyusyunan ang merits ng kaso. The gag order is for the entire case. Not only for the parties and their counsels, even you (referring to media),” ani Chavez.

Nagsimula ang isyu nang humingi ng permanent protection order (PPO) si Aquino sa korte para hindi makalapit ang dating asawa na si Yap sa kanila na inakusahan niya ng "overt sexual advances."

Sa PPO na hiningi ni Aquino, hindi maaring lumapit si Yap sa kanya, kay Bimby, at kahit sa kaninong tao sa bahay. Mayroon din dapat 100 metrong distansya si Yap mula sa bahay ni Aquino, sa paaralan ng bata, at lugar ng trabaho ng mag-ina.

Kung sakaling paboran ng korte ang PPO at kung magpumilit si Yap na lumapit ay maaari siyan arestuhin ng mga awtoridad.

Pero sa petisyon ni Yap sinabi nitong walang ebidensyang magpapatunay upang paboran ng korte ang PPO laban sa kanya.

“The allegations relied upon by Ms. Aquino in her application for the issuance of the TPO and or a permanent protection order are all self-serving and fabricated,” ayon sa petisyon.

Sinabi ni Yap na ang mga ginagawang alegasyon ni Aquino ay upang mailayo sa kanya ang anak na si Bimby at matanggalan ng karapatan na bisitahin ito.

“As can be seen from the petition, nowhere did Ms. Aquino attach sufficient evidence such as, but not limited to judicial affidavits, sworn statements or any other documentary evidence sufficient in law, to prove all the allegations relied upon for the issuance of a TPO and or PPO. Ms. Aquino merely relied on her self-serving accounts of facts and circumstances, giving rise to her alleged right to the issuance of said protection orders,” sabi ni Yap sa petisyon..

Sinagot naman ni Chavez ang HDO ni Yap at sinabing walang ‘flight risks’ ang mag-inang si Aquino at Bimby.

“An HDO is issued only when the party is a flight risk. Kris Aquino and Bimby are not flight risks. They have everything here.  Their careers, their homes, their relatives. It is fractured reasoning to apply for a hold departure order in disregard of all these factors,” sabi ni Chavez.
