Contempt case vs De Lima, abugado ibinasura ng korte

MANILA, Philippines — Ibinasura ng Muntinlupa Regional Trial Court (RTC) nitong Biyernes ang kasong contempt laban kay Senator Leila de Lima at sa kaniyang abugado kaugnay sa kanilang mga pahayag tungkol sa mga testimonya ng mga testigo ng prosekusyon.

Sa 33-pahinang desisyon ng Muntinlupa RTC Branch 206, ibinasura ang petition to cite in indirect contempt laban kay De Lima at Atty. Filibon Tacardon dahil sa ‘lack of merit’ at idineklarang ‘moot and academic’ ang iba pang nakabinbing insidente.

“[W]hat respondent Atty. Tacardon reported to the media are mere echoes of the testimonies of the prosecution witnesses. The court does not find malice in them nor contumacious in those statements,” ayon sa desisyon.

“If respondent Atty. Tacardon cannot be punished for those statements, the same can be said true likewise for Senator De Lima. Her indictment to the case was on the basis of complicity; of she having authorized respondent Atty. Tacardon to make those statements,” sinabi pa ng korte.

Iginiit ng mga petisyuner na nilabag ni Tacardon ang “sub judice” rule nang magpahayag sa iba’t ibang media outlets hinggil sa naging testimonya ng mga testigo, na nagsasabi na ang mga pahayag ay “may posibilidad na makahadlang, makahahadlang, o magpapababa sa pangangasiwa ng hustisya.Subalit ayon sa korte, para maituring na contemptuous dapat ay mayroong “clear and present danger to the administration of justice,”na hindi naman nakita.

Hindi rin aniya maituturing na ‘sub-judice’ ang nasabing mga pahayag.

Ang self-confessed drug lord na si Kerwin Espinosa at dating opisyal ng Bureau of Corrections na si Rafael Ragos ay binawi ang kanilang mga alegasyon sa droga laban kay De Lima. Parehong humingi ito ng paumanhin sa kaniya.
