DQ vs Erwin Tulfo ibinasura ng Comelec

MANILA, Philippines — Ibinasura ng Commission on Elections (Comelec) ang petisyon para i-disqualify si Senator-elect Erwin Tulfo sa May 2025 midterm elections.

Sa 25-pahinang desisyon ng Second Division nitong Mayo 22 2025, nakasaad na “dismissed” ang petisyon na madiskwalipika si Tulfo na isinampa ni Berteni “Toto”  Causing at ng Graft-Free Philippines Foundation Inc. (GFPFI) dahil sa kabiguan nila na sumunod sa requirements kabilang ang isinumite nilang certificate of candidacy (COC) na walang affidavit of authentication at hindi nasertipikahan ng secretary.

“Respondent pointed out that Petitioners attached an electronic copy of Respondent’s COC downloaded from the Comelec website sans an Affidavit of Authentication in accordance with Section 4 (2) of Comelec Resolution No. 11046,” ayon sa Second Division.

“Additionally, Respondent also pointed out that there is no Secretary Certificate showing that Petitioner Calonge was duly authorized by Petitioner GFPFI, a juridical entity, to sign on its behalf the Verification and Certification of Non-Forum Shopping, in accordance with Section 5 of Rule 7 of the Rules of Court,” dagdag pa nito.

Sa petisyon, iginiit ni Causing na si Tulfo ay nahatulan sa krimen na kinasasangkutan ng moral turpitude at hindi siya isang Filipino citizen.

Bukod pa rito, anila, ang diumano’y paglabag sa Section 26 ng Article II ng 1987 Constitution para sa equal access sa pagkakataon sa serbisyo publiko, mga probisyon ng political dynasty, at nepotismo.

Nilabag din anila, ang Section 1 ng ­Article  XI ng 1987 Constitution dahil sa hindi pagpapatunay ng kanyang akademikong kwalipikasyon o kakayahang maglingkod sa Pilipinas ng may sukdulang responsibilidad, integridad, katapatan at kahusayan.
