MANILA, Philippines — Binaligtad ng Court of Appeals (CA) ang desisyon ng Muntinlupa Regional Trial Court (RTC) Branch 204 na nag-aabswelto kay dating senadora Leila de Lima sa kinakaharap niyang drug case noong 2023.

Batay sa 12-pahinang desisyon ng CA 8th division, pinaboran ng Appellate Court ang petition for certiorari na inihain ni Solicitor Gene­ral Menardo Guevarra.

“The presence of grave abuse of discretion effectively nullifies the public respondent’s jurisdiction, thereby nega­ting the second re­quisite of double jeopardy. To this, therefore, an acquittal rendered through a judgement marred by grave abuse of discretion cannot be consi­dered an acquittal entitled to the protection against double jeopardy,” paliwanag ng dibisyon.

“In a plethora of ca­ses, the Supreme Court consistently ruled that when grave abuse of discretion taints a judgement, it becomes wholly void,” dagdag pa nito.

Dahil dito, ipinasisilip muli ng CA ang mga ginamit na dokumento at ebidensiya na naging batayan sa pagsasampa ng kaso at acquittal ni de Lima.

Matatandaang si de Lima ay nakulong dahil sa diumano’y pagkakasangkot niya sa illegal drug trade sa loob ng New Bilibid Prison (NBP) noong siya pa ang kalihim ng Department of Justice (DOJ).

Noong Hunyo 24, 2024 naman, ibinasura ng Muntinlupa RTC ang ikatlo at huling drug case ni De Lima.
