Korte Suprema ibinasura ang petisyong libreng COVID-19 'mass testing'

MANILA, Philippines — Tuluyan nang ibinasura ng Kataas-taasang Hukuman ang petisyon ng iba't ibang sektor para magsagawa ng "mass testing" kaugnay ng coronavirus disease (COVID-19) ang gobyerno — sa dahilang hindi raw madidiktahan ng hudikatura ang ehekutibo.

Ito ang naging desisyon ng Korte Suprema matapos ang botong 13-1-1 kaugnay ng hiling na writ of mandamus. Ito ay kahit na inuutusan ng 1987 Constitution ang gobyerno na igiit ang karapatan sa kalusugan.

"The job of the Court is to say what the law is, not dictate how another branch of government should do its job," sabi ng en banc notice mula kay Clerk of Court Edgar Aricheta sa Inggles.

Kasama sa mga nanguna sa nasabing petisyon si dating Social Welfare Secretary Judy Taguiwalo, na nanawagan sa Supreme Court na utusan ang mga miyembro ng Gabinete ni Pangulong Rodrigo Duterte na magpatupad ng mass testing at maglabas ng napapanahong impormasyon hinggil sa COVID-19. Aniya, palpak daw kasi ang pamahalaan sa pagtugon sa problema, bagay na lumalabag na raw sa karapatan sa kalusugan at impormasyon.

Pero ayon sa SC, pwede lang maglabas ng writ of mandamus kung wala nang ibang "administrative remedies" na maaaring gawin hinggil sa sitwasyon.

"There is no showing in their Petition that they have exhausted administrative remedies," sambit ng korte.

"Without a demonstration that an official in the executive branch failed to perform a mandatory, nondiscretionary duty, courts have no authority to issue a writ of mandamus, no matter how dire the emergency."

Leonen: Inirereklamo dapat sumagot

Para kay Associatre Justice Marvic Leonoen, na nag-iisang naiiba ang boto sa mga hurado, dapat ay naghain pa rin ng kanilang komento sa isyu ang mga respondent.

"A ruling on these issues will have a significant impact on the social, political, and economic life of the nation. That alone should have prompted this court to at least require respondents to file a comment without necessarily giving due course to the Petition," sabi niya sa kanyang dissenting opinion.

"These issues are important and have far-reaching implications, and this Court should not pass up the opportunity to address them after hearing both parties."

Kasalukuyang nasa 269,407 na ang tinatamaan ng COVID-19 sa Pilipinas, habang dalawang araw pa lang ang nakalilipas nang iulat ang 259 patay sa virus sa iisang araw lang.

Sumunod din naman daw ang mga petitioners sa mga hinihiling na rekisitos pagdating sa judicial review, lalo na't apektado ang lahat ng pandemya at may legal standing para maghain ng pleading.

"[P] etitioners assert a valid right—their right to information—that they say is being breached by respondents. This assertion, as with that of their right to health, only serves to bolster the grounds of their Petition. At the very least, it merits a comment from the respondents," saad pa ni Leonen.

Lawyers group hindi panghihinaan ng loob

Hindi naitago ng National Union of People's Lawyers (NUPL), na tumayong abogado ng mga petitioner, ang kanilang pagkadismaya sa desisyon ng korte, at sinabing lalo raw nitong sinasarhan ang posibilidad na maproprotektahan ng "inutil" na gobyerno ang kalusugan ng publiko.

Sa kabila nito, hindi naman daw sila panghihinaan ng loob lalo na't teknikalidad lang naman daw ang naginbg dahilan sa pagkakabasura ng petisyon.

"The Resolution dashes hopes that our inept and negligent government will be compelled to do its constitutional duty to protect and respect the people’s rights to health and information," ayon sa NUPL.

"We take inspiring consolation though in the erudite, extensive and compelling dissent that prudently recognized the transcendental import and implication of this case on the people, the nation and the justice system."

Kahapon lang nang ipagmalaki ng Malacañang na pinakamahusay sa buong kontinente ng Asya ang Pilipinas pagdating sa COVID-19 testing kahit na wala itong mass testing program.

Sa sobrang husay daw ng Pilipinas, binigyan pa ni presidential spokesperson Harry Roque ng gradong 85 ang ang COVID-19 response ng bansa.

"We clearly have the best testing policy in the whole of Asia and probably in the whole world because we have exceeded 3 million. As a percentage of total whole population, lubos-lubusan na po 'yan doon sa sinasabing 3% na dapat ma-test na population," ani Roque.
