MANILA, Philippines — Hindi makakapagtrabaho sa Estados Unidos ang mga Pilipinong gamit ang temporary working visas para sa foreign agricultural at non-agricultural workers mula ika-19 ng Enero 2019 hanggang ika-18 ng Enero 2020.

Ayon sa pahayag ng Department of Homeland Security na inilabas sa Federal Register, isa ang Pilipinas sa may matataas na "overstay rate" at pinangangambahan kaugnay sa human trafficking.

"In FY 2017, DHS estimated that nearly 40 percent of H-2B visa holders from the Philippines overstayed their period of authorized stay," sabi ng DHS notice.

Marami rin daw sa mga biktima ng human trafficking mula sa Pilipinas ay naunang nabigyan ng H-2B visas ayon sa DHS at US Department of State.

Dahil dito, maging ang mga may H-2A visas ay hindi muna papayagan.

"DHS and DOS also believe that these overstay and human trafficking concerns are severe enough to warrant removal from the H-2A visa program as well," dagdag ng notice.

Ang H-2A ay temporary visa na ini-isyu para sa foreign agricultural workers habang ang H2-B naman ay ibinibigay sa mga non-agricultural workers sa Estados Unidos.

Nabahala din ang DHS sa pagtaas ng apat na beses sa aplikasyon ng H-2A visa noong 2015-2018.

"The Philippines' continued inclusion creates the potential for abuse, fraud, and other harm to the integrity of the H-2A or H-2B visa programs," sabi nila.

Kasama ng Pilipinas ang mga bansang Dominican Republic (H-2B lang) at Ethiopia sa listahan ng mga bansang pagbabawalan.

Kasalukuyang may H-2A at H-2B visas

Hindi naman nito maaapektuhan agad-agad ang mga Pilipinong may H-2A at H-2B non-immigrant status. 

Aniya, maaapektuhan lang sila nito kung nais nilang palawigin ang kanilang pananatili gamit ang H-2 classification, o lumipat patungo sa ibang H-2 status.

"Similarly, persons holding non-immigrant status other than H-2 status are not affected by this notice unless they seek a change of status to H-2 status," paglilinaw ng DHS.

Maaari lang payagan ang mga Pilipinong magpe-petisyon para makakuha ng H-2A o H-2B depende sa US interest at kung papayagan ng mga otoridad.

Ilan sa mga kailangang mapatunayan ay ang sumusunod:

(1) Evidence from the petitioner demonstrating that a worker with the required skills is not available either from among U.S. workers or from among foreign workers from a country currently on the list described in 8 CFR 214.2 (h)(5)(i)(F)(1)(i) (H-2A nonimmigrants) or 214.2(h)(6)(1)(E)(1) (H-2B nonimmigrants), as applicable;

(2) evidence that the beneficiary has been admitted to the United States previously in H-2A or H-2B status;

(3) the potential for abuse, fraud, or other harm to the integrity of the H-2A or H-2B visa program through the potential admission of a beneficiary from a country not currently on the list; and

(4) such other factors as may serve the U.S. interest. See 8 CFR 214.2(h)(5)(i)(F)(1)(ii) and 8 CFR 214.2(h)(6)(i)(E)(2).
