Manggagawa party-list itinaas sa SC ang diskwalipikasyon

MANILA, Philippines — Naghain ng petisyon sa Korte Suprema ang Manggagawa party-list ngayong Biyernes para mabaliktad ang desisyon ng Commission on Elections na nagdi-diskwalipika sa kanila sa pagtakbo sa halalan sa Mayo.

Sa kanilang petisyon, hiniling ng grupo na maglabas ng preliminary injunction at temporary restraining order ang korte para mapanatili sa listahan ng party-list ang Manggagawa at hayaang mailimbag ang kanilang pangalan sa balota.

“The Comelec has been overzealous in the interpretation and enforcement of its rules to the point of denying a legitimate organization of the marginalized from participating in the elections,” sabi ni Elmer Labog, pambansang pangulo at unang nominado ng grupo.

"Grave abuse of discretion" daw ang ginawa ng Comelec sa pagdi-dismiss ng kanilang aplikasyon.

“We know that we meet all the necessary criteria and we have already complied with the requirements. It is therefore clear that there is no justifiable reason to disqualify us, other than to prevent progressive organizations critical of the Government and the current administration to run,” sabi ni Labog.

Sa kanilang protesta ngayong araw sa labas ng Korte Suprema, kinundena din ng kanilang mga miyembro't taga-suporta ang pagpayag diumano ng Comelec na patakbuhin ang mga "pekeng" party-lists.

“Contrary to its intent to provide a voice for the marginalized within Congress, the partylist system has been coopted by the elite, and traditional politicians by fielding bogus organizations. These are the organizations that should be disqualified,” ani Labog, na chairperson din ng grupong Kilusang Mayo Uno.

Pagbasura at naunang MR

Sa resolusyon na inilabas noong ika-19 ng Disyembre, diniskwalipika ng Comelec en banc ang Manggagawa party-list matapos bigong ilagay sa kanilang aplikasyon na hindi sila "adjunct" o proyektong inorganisa at pinondohan o tinutulungan ng gobyerno.

"After careful perusal of the record of this case, the Commission finds no cogent reason to depart from or reverse the rulng of the Second Division," ayon sa resolusyon ng Comelec noong Disyembre.

Nauna nang ibinasura ng Comelec ang petisyon ng Manggagawa noong Agosto 2018 matapos hindi makasunod sa rekisitos ng Comelec Resolution No. 9366, patikular ang Section 6 (n), Rule 1.

Sa ilalim nito, hinihinging na sabihihin ng grupo sa kanilang aplikasyon ang sumusunod: "that it is not an adjunct or a project organized or an entity funded or assisted by the government."

Sa inihaing motion for reconsideration, sinabi ng Manggagawa sa Item No. 11 ng kanilang petisyon na hindi sila nakatatanggap ng suporta sa kahit na anong organisasyon para sa "partisan political activities."

Dahil dito, nanindigan ang grupo na malawak na masyado ang pahayag na 'yon para maging sakop ang Section 6 (n).

Hindi naman ito kinagat ng Comelec.

"From the foregoing, it is clear that Petitioner failed to meet the requirement of Section 6 (n), Rule 1 of COMELEC Resolution No. 9366. No valid and compelling reason was propounded by the Petitioner for its failure to comply with the said requirement. Thus, the Motion for Reconsideration must be denied," ayon sa desisyon ng Comelec noong Disyembre.

Nanindigan sina Labog na ilalaban ang karapatang tumakbo para makakuha ng pwesto sa Kamara hangga't hindi pa naiimprenta ng Comelec ang mga balota.

"After all, if the petitioner does not recieve any support from any organization, it follows that it is not a project or entity funded or assisted by the government," sabi sa papel na inihain nila kanina sa korte.

Ilalaban daw nila ang pagtataas ng sahod, seguridad sa trabaho, at demokratikong karapatan ng mga napapabayaang sektor kung mananalo.

"We are asking the Supreme Court to intervene and not allow Comelec to disenfranchise our collective right to represent our sector in Congress," sabi ni Labog.
