Carpio ayaw maging CJ

MANILA, Philippines - Tatanggihan ni acting Supreme Court Chief Justice Antonio Carpio ang alok na maging susunod na pinakamataas na hukom sa bansa kung sakaling maging nominado kasunod ng pagkakatanggal ni Maria Lourdes Sereno.

Bumakante ang pwesto matapos mapatalsik ng tuluyan si Sereno laban bilang punong mahistrado kaya maguumpisa na ang paghahanap na papalit sa kanya.

Sa botong 8-6 sa isang espesyal na en banc session, pinaboran ng mga hukom ang quo warranto petisyon ni Solicitor General Jose Calida kung saan kinwestyon niya legalidad ng pagkakatalaga kay Sereno dahil sa hindi pag-file ng SALN..

Sa interview ng ANC, sinabi ni Carpio na naging consistent siya sa petisyon. Isa siya sa bumoto laban sa petisyon ni Calida.

“I look at this at two levels, as head of the institution right now, although temporary, I will have to implement that decision of the court that there’s a vacancy. So we will open it for applications,” ani Carpio.

“On a personal level, because I have voted against it, I don’t want to benefit from it, so I will decline any nomination.
 I have to be consistent with my position that the quo warranto is not the proper way to remove a sitting member of the court,” dagdag niya.

Kung sakaling tanggihan ni Carpio ang nominasyon, tatanggalin na ang kanyang pangalan sa ibibigay na listahan ng Judicial and Bar Council na ipapasa kay Pangulong Rodrigo Duterte na siyang may kapangyarihan para maghirang ng mga bagong miyembro ng judiciary.

Si Carpio -- na siyang pinakamatanda sa SC – ay miyembro ng tribunal mula Oktubre 26, 2001, appointed ni dating Pangulong Gloria Macapagal-Arroyo.

Miyembro siya ng legal team na nanalong kaso ng Pilipinas ukol sa West Philippine Sea sa United Nations-backed tribunal.

Patuloy na nagbibigay si Carpio ng mga pahayag laban sa posisyon ng gobyerno sa usapin ng Scarborough Shoal kasama ng China. 

Magreretiro siya sa Oktubre 26, 2019.

“Well, I’m about to retire so there’s really no... I don’t hanker for any position at this point and if you are a chief justice, you only have one vote—the same as the vote of an associate justice,” sinabi ni Carpio sa ANC.

“And it doesn’t mean that because you are a chief justice, the other justices will follow you. You’ve seen it,” dagdag niya.
