Dating opisyal ng AFP hinatulan ng 216 taon pagkakakulong

MANILA, Philippines — Tiyak na mabubulok sa kulungan ang isang dating opisyal ng Armed Forces of the Philippines (AFP) matapos mahatulan ng 216 na taong pagkakakulong dahil sa pamumulsa ng P3.5 milyong halaga ng real estate tax.

Hinatulang guilty ng Seventh Division ng Sandiganbayan si Retired Brig. Gen. Jose Ramiscal Jr., dating pangulo ng the AFP-Retirement and Separation Benefits System (RSBS) sa tig-12 counts ng graft at falsification of public documents.

Bukod kay Ramiscal, hinatulan din ng kaparehong parusa ang abogadong si Nilo Flaviano, habang naibasura naman ang kaso laban kay AFP-RSBS project director Wilfredo Pabalan na patay na.

Pinagbabayad din sina Ramiscal at Flaviano ng P60,000.

Nag-ugat ang kaso sa pamemeke ng 12 deeds of sale sa ilang bahagi ng lupang binili ng AFP-RSBS noong Setyembre 1997.

Idineklara umano ng mga akusado na nabili lamang ang 999 metro kwadrado na lupa sa halagang P2.997 milyon o P3,000 kada metro kwadrado.

Malayo ito sa nakasaad sa kasunduan na P10.489 milyon o P10,500 kada metro kwadrado.

“Under-declaration of the selling price has its proportionate effect on the payment of capital gains tax and documentary stamp taxes... The government stands prejudiced in terms of shortfall in tax payment,” nakasaad sa 55-pahinang desisyon.

“With the price disparity, it can be perceived that those who authored the falsification pocketed the humongous difference.”
