Comelec ibinasura ang dq case vs Marcos
“Consequently, the representations of Respondent Marcos Jr. in his certificate of candidacy that he is eligible to be elected to the office of the President of the Philippines and that he has not been found liable for an offense which carries with it the accessory penalty of perpetual disqualification from holding public office are NOT FALSE,” ayon sa Comelec division.

MANILA, Philippines — Ibinasura ng Commission on Elections (Comelec) Second Division ang ‘petition to cancel the candidacy’ na isinampa laban kay presidential aspirant Ferdinand “Bongbong” Marcos Jr.

Sa resolusyon na pinonente ng 2nd Division na hindi mali ang mga inilagay na representasyon ni Marcos sa kaniyang COC.

“Consequently, the representations of Respondent Marcos Jr. in his certificate of candidacy that he is eligible to be elected to the office of the President of the Philippines and that he has not been found liable for an offense which carries with it the accessory penalty of perpetual disqualification from holding public office are NOT FALSE,” ayon sa Comelec division.

“Thus, there is no legal justification to deny due course to or cancel the certificate of candidacy of Respondent Marcos Jr.,” dagdag nito.

Sa kasong tax evasion, ikinatwiran ng 2nd Division na hindi nagbaba ng parusang ‘perpetual disqualification from holding public office, voting and participating in any election’ ang Court of Appeals laban kay Marcos kaya’t  nananatiling ‘eligible’ si Marcos na tumakbo sa halalan.

Sa argumento na sinadya na lokohin o i-mislead ang publiko sa impormasyon sa kaniyang COC, sinabi ng 2nd Division na dahil sa desisyon ng CA, walang dahilan si Marcos na i-mislead ang publiko dahil sa naniniwala siya na kuwalipikado siyang tumakbo sa halalan.
