When in quarantine, write your last will and testament

WHAT MATTERS MOST - Atty. Josephus B. Jimenez - The Freeman

You can write it on a piece of yellow pad, bond paper or a notebook, or even in a scrap book. It must be dated and the place where you are writing the same should be stated. First, you need to state your name, and that you are a Filipino, of legal age, married or single or widow/widower, and a permanent resident of a definite address. Then you declare that you are of sound and disposing mind, and being so, you are writing your will of your own volition and without any force, intimidation or undue influence being exerted by anyone any time. And having stated thus, the following should be followed as your heirs and testament. First, name all your heirs and enumerate all your properties, real, personal, bank assets and cash.

First declare that your body should not be cremated but buried in your hometown, according to the rites of the Catholic Church, in a decent burial place you have prepared beside your parents. Then the ancestral home you have built in Metro Manila is left to your surviving spouse, as her share as conjugal partner and also as her share from the legitime of the testator's estate, and the condo in Fort Bonifacio is given to your youngest son. The land in your hometown shall be divided by your eldest son, eldest daughter, and middle child equally, with the condition that they shall not eject the occupants, who are not tenants but residents by tolerance, and they need to preserve the whole property, never to alienate the same to others, than a descendant of the testator in memory of the original owners, the maternal grandparents of the testator.

And that the land in the poblacion in your hometown shall be given to the youngest daughter. All the books and mementos, all the awards, trophies and certificates and personal effects of the testator now inside his office and library shall be sent to his hometown, and be put in a small library and memorial house to be constructed in a small portion of that land. And that whatever royalties from all the books he has written shall accrue to his spouse and his youngest daughter who is asked to use all his remaining assets for the construction of the small memorial and library in his hometown. Then the testator appoints a lawyer friend in his hometown to be the executor of his will, to see to it that all his wishes are implemented, and that the heirs shall follow the same in the spirit of affirming their love and respect. If your will consists of many pages, each page should be signed, dated, and paginated.

Then original of the will shall be kept in the bank vault or a bag that is locked, and a copy of the same be secretly emailed or sent to the appointed executor. Even if you do not have much properties, it is preferable that you put all your wishes in writing and that you put all things in order, before you leave for good and in peace.
