A road rage incident goes viral in Cebu

Last Saturday evening, I was in Makati for the weekend and stayed on the 24th floor of the New World Hotel, when I noticed a fireworks display that was obviously expensive looking (at the direction of the Mall of Asia) as it showed many shapes and forms that pyrotechnic makers could manipulate. When I got hold of yesterday’s front-page photo from the Philippine STAR, I learned that the fireworks display came from the 8th Philippine International Pyromusical Competition at the Mall of Asia. Call me lucky that even from afar I was able to see that wonderful event. Thanks also to New World Hotel’s wonderful staff for the special service they gave me (I used a Wilkins distilled water) with my water needs as kidney transplant patient.

Let me write this warning to motorists who carry their firearms inside their cars because these are different times, and when your hot head pops up and you end up in a road rage incident, chances are high that someone with a cellphone camera might just take a video of your road rage and goes viral in our social media networks. This incident was a big hit in Facebook!

What happened last Saturday dawn in Cebu City was a traffic altercation along F. Sotto St. (behind the USC Boys High School or North Campus) when a fellow driving a Mercedes Benz figured in a road rage incident and this altercation ended with the driver of the Mercedes Benz with a gun shooting a male nurse. Someone had apparently taken a cellphone video of this road rage and splashed it in Facebook and it went viral. The driver of the Mercedes Benz was tagged as Mr. David Lim Jr., while the person that he shot was a nurse named Ephraim Nuñal who was wounded in his legs.

Interestingly, last March 3, the father, Mr. David Lim Sr. also figured in a road accident when his Nissan GT sports car slammed into the motorcycle of fish vendor dealer Mr. Philip Pogoy who died on the way to the hospital. At this point we have no way of finding out whether a case of driving through reckless imprudence was filed against Mr. Lim Sr. as we learned that he “settled” with the family of Mr. Pogoy. Can we really settle a crime of reckless imprudence? Incidentally, Mr. David Lim is the estranged brother of Mr. Peter Lim who figured in Pres. Rodrigo “Digong” Duterte’s list of drug lords. But in fairness to Peter Lim, he had nothing to do with this!

This incident reminded me of an earlier road rage incident that happened 26 years ago when on July 2, 1991 it became a raging news. This was when Rolito Go figured in a near accident with the 25-year-old Eldon Maguan who was merely getting a pizza for his family. In his rage (he was allegedly fighting with his girlfriend) Rolito Go shot Maguan in the head and the entire nation was outraged! We learned that last Dec. 16, Rolito Go was ordered released by the Supreme Court after serving his long sentence, which was commuted for humanitarian reasons. He apparently has stage 4 cancer and was not expected to live long.

This road rage incident became viral in Facebook over the weekend and made the headline news in our local dailies. Not to be outdone, no less than Mayor Tomas Osmeña reported in his Facebook page that he brought along his SWAT team first to the Windland Tower condo of David Lim Jr., but failing to find him there, he then went to the house of Mr. David Lim Sr. the father of the principal suspect.

But Mayor Osmeña admitted that he asked a Judge (he is still unnamed) for a search warrant, but the judge refused to issue a search warrant. Now I would like to know why this Judge refused to give a search warrant to the Cebu City Mayor who was searching for David Lim Jr. who has since left the crime scene.

With no search warrant in his hands, the Cebu City Mayor still proceeded to search the Windland Towers where David Lim Jr. supposedly had a condo, then the Mayor and his SWAT team went to the father’s house in Maria Luisa Subdivision and forcibly entered his house. Mr. Lim Sr. told the Cebu City Mayor that he doesn’t know the whereabouts of his son. The Cebu City Mayor mentioned in his Facebook that he takes responsibilities for any legality he may encounter in entering a house sans a search warrant.

While Mayor Osmeña may claim that he was in “hot pursuit” operations, he knew that entering the residence of Mr. David Lim was a violation of Mr. Lim’s rights. If he didn’t ask for a search warrant, he may get away with his claim of doing hot pursuit operations. Let me say it here that Mayor Osmeña took a lot of risks and one of them he hopes that Mr. Lim wouldn’t file any case against him.

What Mayor Osmeña did was a popular move because Cebuanos were outraged that we had a Rolito Go clone in our midst. So you can say that Mayor Osmeña rode on this issue to gain some popularity as his popularity has been sagging lately because of his anti-business policies?
