Lawyer fears Dacera case evidence tampered

MANILA, Philippines — The men accused in the death of flight attendant Christine Dacera fear that police may present tampered evidence to bolster the rape with homicide case filed against them, a defense lawyer said on Thursday.

“We think that any evidence (presented) after (deciding for) further investigation by the fiscal could be tampered, highly suspicious,” lawyer Abigail Portugal, who represents some of the 11 respondents, told Teleradyo.

During the preliminary investigation last Wednesday, the Makati City police asked the city prosecutor to set another hearing as they are “still awaiting results of DNA analysis, toxicology/chemical analysis, histopath examination, and laboratory results from the Makati Medical Center.”

The city prosecutor scheduled the next hearing on Jan. 27.

Portugal said their camp is waiting for the results and to provide supplemental statements.

During Wednesday’s hearing, respondents John Pascual dela Serna III and Rommel Galido and three others filed their joint affidavit.

Portugal alleged that the city police altered their initial statements to include drug use during the New Year’s Eve party they and Dacera attended hours before she was found unresponsive in the hotel bathtub.

“They were forced to sign, they did not know more details were added to their statement… there was no mention of drugs so we had to correct it (their first statement),” the lawyer said.

Portugal maintained that the city police “coerced” the respondents, including Dela Serna and Galido, who were both detained, to blame others.

“They were coerced. If they would not blame anyone in relation to drugs they would be detained longer,” she said.

Galido earlier claimed that Dacera suspected that a certain Mark Anthony Rosales, who is among the respondents, allegedly spiked her drink. Galido retracted the allegation in the joint counter-affidavit during last Wednesday’s hearing.
