AFP seeks custody of PMA cadets in hazing death

MANILA, Philippines — The Armed Forces of the Philippines (AFP) wants to retain custody of the suspects in the fatal hazing of Philippine Military Academy (PMA) 4th class cadet Darwin Dormitorio.

AFP spokesman Maj. Gen. Edgard Arevalo said former cadets Shalimar Imperial, Felix Lumbag and Julius Tadena should remain in their custody while being tried in a military tribunal.

In a decision issued on Wednesday, Baguio Regional Trial Court Branch 5 Judge Maria Ligaya Itliong-Rivera ordered the transfer of the suspects to the Baguio City jail pending resolution of the AFP’s petition for custody.

“Humingi tayo ng permiso sa korte para i-retain muna yung custody na meron tayo dito sa mga ito. Kung mag-resolve na ang korte na sabihin nila na no we deny your petition, that’s the time we will take appropriate action,” Arevalo said.

He said the AFP has acquired jurisidiction over the three former cadets, who are undergoing general court martial for conduct prejudicial to good order and military discipline.

Arevalo said the three are in detention even though they are under AFP custody, adding that they are willing to present the accused in civilian court when needed.

Imperial and Lumbag were charged with murder and hazing last month. Tadena was charged with hazing and less serious physical injuries.

Also facing charges in connection with Dormitorio’s death are former PMA Hospital chief Lt. Col. Ceasar Candelaria and medical officers Capt. Flor Apple Apostol and Maj. Maria Ofelia Beloy.
