Capitol okays demolition of a house built on barangay road in Kawit, Medellin

CEBU, Philippines - The Capitol has told Medellin Mayor Ricardo Ramirez to demolish the house erected on a public barangay road in Kawit owned by a certain Tirso Seares.

Lawyer Ritchie Capahi of the Provincial Legal Office has opined  that a civil case for ejectment is not necessary as the house or structure erected maybe a “nuisance” and contrary to the municipality’s interest and illegal.

“In addition, said structure appears to have no permit,” said Capahi in his letter dated October 10, 2013 addressed to Ramirez.

Capahi however cautioned Ramirez to a resolution from the municipal council declaring said structure a nuisance and at the same time authorizing the mayor to demolish the same.    

Earlier, the council passed a resolution authorizing Ramirez to institute and file civil case for ejectment against Seares or anyone acting in his behalf with respect to an illegal structure standing on a barangay road.

Ramirez said that after he received the letter from the Capitol, he decided defer implementation of the demolition after the barangay election.

Prior to this, Ramirez said that he has been communicating the owner that the municipal government is willing to provide assistance to relocate the structure but he got no reply.

“Ang tanan paagi nahurot na nako pagpangita og solusyun nga wala’y mga balatian masamdan apan mura’g kini nalang paagiha ang nahabilin para sa akoa aron kapanalipdan nako ang interes sa mga Kawitanon,” Ramirez said. — (FREEMAN)
