MANILA, Philippines — Hinarangan ni Pangulong Rodrigo Duterte ang tuluyang pagsasabatas ng SIM card registration bill, bagay na mag-oobliga rin daw ng pagpaparehistro ng social media accounts dahil dudulo raw ito sa sobra-sobrang pakikialam ng estado sa mga indibidwal.

"The President has decided to veto the consolidated Senate Bill No. 2395/House Bill No. 5793, which seeks to mandate the registration of all SIM Cards and social media accounts, with the purpose of deterring electronic communication-aided crimes," wika ni acting presidential spokesperson Martin Andanar, Biyernes.

"The President noted that the inclusion of social media providerts in the registration requirement was not part of the original version of the bill and needs a more thorough study."

Bukod pa rito, sinabi raw ni Duterte na ang ilang detalye pagdating sa "state intrusion" ay hindi gaano naplantsa at napag-usapan sa panukalang batas, lalo na pagdating sa pagpaparehistro ng social media accounts.

Sa kabila nito, ikinatutuwa raw ni Duterte ang pagsusumikap ng lehislatura na tugunan ang gobyerno ang lumalalang problema ng cybercrimes at information and communications technology-related offenses. Gayunpaman, tila sobra-sobra raw ang mga nakalangkap ditong probisyon sa kasalukuyan.

Umaasa naman si Digong na itutuloy pa rin nila ang pagbalangkas ng kahalintulad na panukala na magbibigay sa mamamayan ng ligtas na online environment, pero kailangan pa rin daw nitong makatayo sa judicial scrutiny.

"[He was just] constrained to disagree with the inclusion of social media [registration] in the measure, without providing proper guidelines and definitions thereto, as the same may give rise to a situation of dangerous state intrusion and surveillance threatening many constitutionally protected rights," dagdag pa ni Andanar.

"It is incumbent upon the Office of the President to ensure that any statute is consistent with the demands of the Constitution, such as those which guarantee individual privacy and free speech."

Isyu sa seguridad

Pebrero 2022 lang nang magpakita ng suporta ang tatlong dambuhalang telecommunications companies para sa SIM Card Registration Act, na siyang magre-require sa lahat ng bibili ng kanilang SIM na magsumite ng personal na impormasyon.

Sa kabila nito, binanatan ito ng ilang cybersecurity policy analysts gaya nina Mary Grace Mirandilla-Santos, at sinabing maaaring magkaroon ito ng mas maraming negatibong epekto sa madla kaysa positibo.

"SIM registration has the potential to put the security, privacy, and welfare of citizens at risk. Experiences from other developing countries and the European Union show that SIM card registration may pose more risks than benefits to citizens," sabi niya sa Philstar.com ilang buwan na ang nakalilipas.

Una nang sinabi ng non-profit organization na Privacy International na napatunayang "ineffective" at "inefficient" ang mga SIM card registration policies na sinubukang ipatupad noon sa Canada, Czech Republic, Netherlands at Ireland. Inatas din ng Mexico ang dati nilang polisiya matapos matuklasang hindi ito mabisa.

Disyembre lang nang mabahala rito ang Makabayan bloc lalo na't pwedeng-pwede raw itong gamitin para maniktik, mang-harass at manindak ng mga aktibista, kritiko ng gobyerno at karaniwang mamamayan.
