90-araw suspension sa ex-SBMA exec, ‘invalid’ - SC

MANILA, Philippines — Idineklara ng Supreme Court First Division na inva­lid at walang legal effect ang 90-araw na suspensiyon na ipinataw noong Agosto 2021 laban kay Stefani Saño, dating Senior Deputy Administrator for Business and Investment ng Subic Bay Metropolitan Authority (SBMA).

Sa 14-pahinang desis­yon, kinatigan ng korte ang argument ni Saño na pinagkaitan siya ng due process nang  suspendihin siya ni dating SBMA chairman at administrator Roberto Garcia sa loob ng 90 araw dahil sa diumano’y misconduct kaugnay ng kuwestiyonableng shipment ng 420,000 sako ng Indian rice noong Abril 2, 2012.

“The favorable decision of the Supreme Court brings joy not only to me but also to my family, colleagues and friends who all suffered because of the unjust and atrocious treatment I got from certain officials of a previous administration of the SBMA. We all feel relieved with this vindication,” sabi ni Saño.

Dagdag pa ng dating SBMA executive: “The emphasis is on due process. This is a constitutional right which cannot be violated by anyone.”

Umaasa naman si Saño na ang desisyon ng Korte Suprema ay magsusulong sa mga kawani na magsalita kapag nilalalabag ang kanilang karapatan ng kanilang mga superior.

“I hope this vindication sends strong signals to tyrants and would-be tyrants in the agencies and offices, government and private alike: You cannot just charge and suspend people. Everyone has a right to due process,” saad pa nito.
