MANILA, Philippines — Nanawagan ang Commission on Human Rights na mapanagot ang nasa likod ng diumano'y pagnanakaw ng personal na datos ng mga passport holders.

"CHR reiterates the importance of the right to privacy in preserving human dignity as stated in various human rights documents, including the 1987 Philippine Constitution, the Universal Declaration of Human Rights, and the Data Privacy Act of 2012," ayon kay CHR spokesperson Atty Jacqueline de Guia. 

Isiniwalat kamakailan ni Department of Foreign Affairs Secretary Teodoro Locsin Jr. na itinakas ng French contractor na Francois-Charles Oberthur Fiduciare ang mga datos.

Kaugnay nito, pinalakpakan ng CHR ang National Privacy Commission sa kanilang pag-iimbestiga tungkol sa data breach. 

"To this end, we urge the government to identify accountabilities and determine all applicable penalties, as determined by our laws, in preserving the rights of all concerned and in the interest of national security," dagdag ni De Guia.

Para masiguro ang privacy ng taumbayan, pinasisilip naman ng tanggapan ni Sen. Nancy Binay sa Office of the Solicitor General ang mga kontrata ng gobyerno sa mga third-party software at data management providers, lalo na ang mga may kinalaman sa mga national database.

"We need to step up our standards when it comes to data protection and security lalo na't ang may hawak ng data management ay 3rd party contractors. We need to know which agencies are prone to data hostaging para di na maulit ang nangyari noon sa LTO at NBI where there was a stoppage of operations, and vital public services were affected," sabi ng senadora.

Giit ni Binay, dapat siguraduhin ng OSG na may probisyon ang mga kontrata na dapat ibalik sa gobyerno ang mga datos kapag na-terminate ang mga kontrata.

"Bilang tagapangalaga ng datos ng mamamayan, the government should protect the confidentiality of the data, and maximize all remedies to ensure that the data handled by contractors is returned to the government after the end of its contract," dagdag ni Binay.

Nauna nang sinabi ng dating DFA secretary na si Perfecto Yasay Jr. na "misinformed" lang si Locsin tungkol sa data breach.

"The only reason, compelling reason I can see is because they wanted to deflect the real issue of the passport mess, which is awarding, the production of the passport from an end-to-end basis," sabi ni Yasay.

Hindi pa naman nagbibigay ng pormal na posisyon ang Malacañang tungkol sa insidente ayon kay presidential spokesperson Salvador Panelo sa isang press briefing kanina. Kailangan pa raw muna niyang mabasa ang mga pormal na dokumento.

"Eh una nga hindi pa natin sigurado kung nawawala nga o hindi. Kasi may nagsasabi namang nandyan, may nagsasabi namang hindi. So I'd rather not make any comment unless facts have been given to my office," sabi ni Panelo.

Nang tanungin kung maaaring utusan ng gobyerno ang French company na ibalik ang mga datos kung mapatutunayang totoo ang alegasyon, sinabi naman ni Panelo na maaari itong gawin.

"Certainly, the data belongs to this government... Baka idemanda pa natin sila ng theft. But right now hindi pa nga natin alam kung sino ang may hawak, anong kontrata. Puros 'he said this,' 'he said that.' I need documents," dagdag niya.
