Mosyon ni Vhong Navarro ibinasura ng CA

MANILA, Philippines — Ibinasura ng Court of Appeals (CA) ang mosyon ng aktor at TV host na si Vhong Navarro na ipatigil ang pagsasampa ng mga kasong rape at acts of lasciviousness na inihain ng modelong si Deniece Cornejo.

Sa pitong pahinang kautusan na ipinalabas noong Setyembre 20, 2022 na kahapon lamang naibahagi sa mga mamamahayag ay ibinasura ng CA Special Fourteenth Division  ang inihaing motions for reconsideration  at kahilingan na mag-isyu ng status quo ante order upang harangin ang naunang resolusyon na nag-aatas sa Taguig Office of City Prosecutor na isulong na sa korte ang mga kasong nabanggit.

 “A status quo ante order has the nature of a temporary restraining order. It is an established doctrine that injunction will not lie to enjoin a criminal prosecution,” ani CA Associate Justice Florencio Mamauag, Jr. sa resolusyong sinang-ayunan nina associate justices Walter Ong at Mary Charlene Hernandez-Azura.

“The reason for this rule is that the accused has an adequate remedy at law by establishing as a defense to the prosecution that he did not commit the act charged, or that the statute, on which the prosecution is based, is void, and, in case of conviction, be taking an appeal. Public interest requires that criminal acts be immediately investigated and prosecuted for the protection of society,” paliwanag pa dito na nagsasabing ang kaso ni Navarro ay hindi kasali sa alinmang exceptions.

Sa pagbasura sa MR ni Navarro, sinabi ng CA Special 14th Division na habang ang mga prosecutors ay may ‘discretion’ sa pagtukoy ng probable cause sa paghahain ng mga kaso, maaari namang repasuhin ng korte kung may labis na pag-abuso sa discretion. - Danilo Garcia
