Usa sa mga kaso sa Cebu 8 gibasura

CEBU, Philippines — Gibasura sa korte ang usa sa tulo ka mga kasong gipasaka batok sa gibansagang “Cebu 8” nga gidakop tungod sa pasangil nga nakalapas sila sa pagdili sa mass gathering samtang adunay pandemiya sa dihang nag-rally sila kaniadtong Hunyo 5, 2020 atubangan sa University of the Philippines-Cebu Campus nga gitawag nilang Black Friday Protest.

Sa hiniusang kamandoan nga giluwatan sa Municipal Trial Court in Cities (MTCC) Branch 9 Presiding Judge Amy Soler-Rellin kaniadtong Agosto 19, 2020 giingon nga pakyas ug walay basehanan ug merito subay sa Sec. 9 sa RA 11332 nga gibase sab sa Executive Order No. 79 sa Cebu City nga nagdili sa mga ‘social gatherings.’

 Ang kalapasan RA 11332 naila usab nga “Mandatory Reporting of Notifiable Diseases and Health Events of Public Health Concern Act.” Padayon pang husayon ang laing duha ka mga kaso batok sa walo nga mao ang paglapas sa Section 13 (a) sa BP Blg. 880  ug simple resistance and disobedience to an agent of a person in authority.

Ang mga gipangkasohan mao sila si Jaime Paglinawan, Joahanna Veloso, Al Ingking, Bern Cañedo, April Dyan Gumanao, Nar Porlas, ug Clement Corominas ug Janry Ubal.

Sila Corominas ug Ubal kusganong mihimakak nga miyembro sila sa mga militanteng pundok. Una na silang namahayag human sila gidakop nga igo ra silang nanan-aw sa mga nagprotesta apan giapil sila sa pagsikop tungod sa paglapas sa quarantine protocols.

Sa pamahayag nga gipagawas sa National Union of People’ Lawyers (NUPL) Cebu nga gipetsahan niadtong Septiyembre 8,2020, giingon nga ang korte wala makakita og ebidensya ‘on record’ nga ang mga akusado adunay COVID- 19 sa oras nga sila gidakup sukwahi sa kung unsa ang gipasaka batok kanila.

“While undeniably the COVID-19 pandemic is a global and local public health emergency, a sweeping generalization that the entire population is identified as being affected by such health event of public concern cannot simply be made. This is so, considering that RA 11332 specifically relates to mandatory reporting of notifiable diseases and health events of public concern, and related activities such as disease surveillance, epidemiologic investigation or response activities by the DOH and other public health authorities in the national and local levels,” sigon sa maong statement sa NUPL nga nagkutlo sa maong joint order sa korte.

“Thus, the cooperation seemingly pertains, not to everyone, but to persons affected with the notifiable disease and/or persons and entities assigned with the compulsory tasks and duties under RA 11332 and are mandated to extend cooperation. In this case, there is neither no allegation nor showing that such circumstances exist to warrant accused’s prosecution under the law,” dugang pa sa kamandoan.

Ang NUPL mihangop sa pagbasura sa maong kaso ug malaumon nga mabasura sab ang laing duha ka kaso sa ilang mga kliyente nga giingong igo rang nipadayag sa ilang constitutional rights paghimo og peaceful assembly ug kagawasan sa pagpadayag.
