Noynoy pinagkokomento ng Ombudsman sa DAP case

MANILA, Philippines - Pinagkokomento ng Special Panel of Investigators ng Ombudsman sa loob ng 15 araw si dating Pangulong Noynoy Aquino kaugnay ng reklamong may kinalaman sa Disbursement Acceleration Program (DAP) noong nagdaang administrasyon.

Sa kasong ito, una nang nakakita ng probable cause ang Ombudsman para papanagutin si dating Budget Secretary Butch Abad sa kasong usurpation of legislative powers nang magpalabas ng National Budget Circular (NBC) 541 na nagpapatupad sa DAP na kinapapalooban ng P72 bilyong halaga.

Sa press statement ng Ombudsman, sinabi nitong nanghimasok si Abad sa kapangyarihan ng Kongreso nang mag-isyu ng NBC 541.

“NBC No. 541 provided the principal bases for the withdrawal of unobligated allotments which were declared as savings and used to fund PAPs (programs, activities and projects) under the DAP. The issuance of this circular is an act of usurpation. This is contrary to law,” ayon sa Ombudsman.

Noong 2014, naidekla­ra ng Korte Suprema na unconstitutional ang tatlong bahagi ng DAP.

Partikular dito ang pondo na nanggaling sa hindi lehitimong savings, pondo na nailipat patungo sa ibang sangay ng pamahalaan at paggamit ng unprogrammed fund na walang sertipikasyon mula sa national treasurer.

“Under Article 239 of the RPC, the penalties of prision correccional in its minimum period, temporary special disqualification, shall be imposed upon an executive or judicial officer who shall encroach upon the powers of the legislative branch of the Government, either by making general rules or regulations beyond the scope of his authority, or by attempting to repeal a law or suspending the execution thereof,” dagdag ng Ombudsman.

Una nang ipinaliwanag ni Abad na hindi siya nagbenepisyo sa DAP at wala silang  masamang intensiyon ni Aquino sa pagpapatupad sa economic stimulus program.
