South Bus Terminal guard suspended for leaving post

CEBU, Philippines — A member of the Civil Security Services Division of the Cebu provincial government is suspended for a month after the Capitol's Committee on Discipline and Investigation (CODI) found him guilty of insubordination.

Diosdado Delicano who is detailed at the Cebu South Bus Terminal and has been working for 13 years was charged for allegedly leaving his post several times without the permission of his superior.

Upon investigation, CCTV clips proved that he was not in his station or anywhere in the terminal.

The video footage also proved that he lied when he said that he was helping someone within the terminal when he left his post.

CSBT Security Management head Joy Tumulak filed a complaint against Delicano a year ago but it is only now that the CODI handed down its decision.

In his verified response, Delicano “failed to show controverting evidence. In fact, in one conference, Delicano admitted that he also sleeps at times when he is on duty.

Delicano, as stated in the official report, was called multiple times by his superior to remind him of his duties. However, despite multiple warning, the man kept on disappearing during his duty hours.

In the CODI decision, the committee stressed that he should not leave his post to do jobs which are outside his functions.

Meanwhile, in another video, Delicano was recorded shoving away his superior as he allegedly defied the latter’s orders.

With the pieces of evidence, the CODI found probable cause in March to hold him for trial and a formal charge of insubordination. A series of conferences were set and held.

“WHEREFORE, the Committee finds respondent Diosdado I. Delicano, guilty of this charge for insubordination pursuant to Section 50 (D-5)of the 2017 Rules on Administrative Cases in the Civil Service and hereby imposes upon him the lowest penalty of suspension for one (1) month without pay. It bears emphasis that a higher penalty could have been imposed,” stated in the CODI resolution.

Yesterday, the Office of the Governor released Administrative Order No. 2017-09 imposing the penalty of suspension to Delicano. The governor approved the recommendation of the CODI which is in accordance with Rule 10 Section 50 (D-5).

Civil Security Unit (CSU) head Bobby Legaspi said that he hopes that the case of Delicano may serve as a reminder to the CSU guards that they have a job to uphold.

He added that if Delicano were to get involved in another complaint, it will be a ground for dismissal. (FREEMAN)
