4 indicted for murder

CEBU, Philippines - Four people were charged in court after the Cebu City Prosecutor’s Office has found probable cause to indict them in the murder of a customer of a convenience store in Barangay Guadalupe in 2014.

Prosecutor Naruzen Delfin Lorete recommended the filing of the murder case in court against Darryl Revillas, 19; Meljun Caballes, 22; Kyrex Torres, 20; and Richard Calunsag, 21, all residents of  Barangay Ermita, Cebu City.

The four were tagged by witnesses to have connived in the killing of Jay Alcoseba on December 25, 2014. The prosecutor did not recommend bail for their temporary liberty.

“The uncontested allegations of the eyewitnesses showed respondents’ unified act in killing Jay Alcoseba. Hence, conspiracy is clear. Respondents were also positively identified by the eyewitnesses,” the resolution read.

 Witnesses Joselito Nanoy and Dave Garciano said that they were having a drinking session at around 6 p.m. on December 25, 2014 to celebrate Christmas at a convenience store along Englis V. Rama, Guadalupe.

Calunsag joined them and asked if he can invite Caballes to be with them. Caballes later arrived together with Revillas and a certain Erwin.

According to Nanoy, Caballes showed to him a caliber .45 pistol. At midnight, Nanoy said he saw Torres hit Alcoseba with an empty bottle in the head causing the latter to fall.

Alcoseba stood up and ran but a certain Erwin chased him while Revillas blocked his way and stabbed him while Caballes shot the victim twice.

Nanoy and Garciano said they fled from the area because of fear. Alcoseba was brought to the hospital by his friends Hirosi Yokotan and Syriel Olivar but he died five days later.

The accused were summoned to submit their counter-affidavits but allegedly failed despite the reasonable time given to them.

Lorete said she was forced to resolve the complaint based on the evidence at hand. (FREEMAN)
