Kaso ni Noy sa Mamasapano massacre tuloy

MANILA, Philippines — Pinagtibay ng Office of the Ombudsman ang pagsasampa ng kasong kriminal laban kay dating Pangulo Benigno Aquino III at dalawa pa kaugnay ng 2015 Mamasapano massacre.

Sa 26-pahinang desisyon, iginiit ng anti-graft court na may probable cause para kasuhan si Aquino sa Sandiganbayan ng usurpation of authority under Article 177 ng Revised Penal Code at paglabag sa Section 3 (a) ng Republic Act 3019 o ang Anti-Graft and Corrupt Practices Act.

Nilagdaan ni Ombudsman Conchita Carpio Morales ang desisyon nitong Setyembre 11.

Bukod kay Aquino, kasama rin sa kaso sina dating Philippine National Police chief Alan Purisima at dating PNP-Special Action Force director Getulio Napeñas Jr.

May hiwalay pang kasong graft at usurpation of authority sina Purisima at Napeñas sa Sandiganbayan dahil pa rin sa Mamasapano clash.

“After a considered evaluation of the arguments raised by the movants vis-a-vis the evidence on record, the Office finds no cogent reason to reverse or modify the assailed resolution,” nakasaad sa desisyon.

Nauna nang sinabi ng Ombudsman nitong Hunyo na dapat managot sina Aquino at Purisima para sa madugong “Oplan Exodus” na tinarget si Malaysian terrorist Zulkifli bin Hir alyas Marwan at Filipino bomb maker Abdul Basit Usman.

Pinuna ng Ombudsman ang desisyon ni Aquino na ipamahala kay Purisima ang operasyon sa kabila ng preventive suspension order dahil sa maanomalyang PNP deal.

“To this Office, President Aquino's act of utilizing the services of Purisima for Oplan Exodus set into motion the latter's participation and involvement therein prior to and during its implementation.”
